These Terms of Service ("Terms") govern your access to and use of the Xwork desktop application, website, and related services (collectively, the "Service"), operated by Xcodex Technology LLC, a Wyoming limited liability company ("Xwork", "we", "us").
By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old, capable of forming a binding contract, and not barred from using the Service under the laws of the United States or your local jurisdiction.
You are responsible for keeping your account credentials secure. You must promptly notify us of any unauthorized access. You may not share your account with others. We may suspend or terminate accounts that violate these Terms.
Xwork provides software that lets you interact with third-party large language models and related AI services through a unified desktop interface, on a pay-per-use basis. We are an independent software vendor; we do not warrant the output of any AI model.
You agree not to use the Service to:
The Service is billed on a pay-as-you-go basis. Top-ups are charged at the time of purchase via Stripe. Usage is deducted from your balance in real time at the rates published on our Pricing page. Refunds for unused balance are governed by our Refund Policy.
You retain all rights to the prompts you submit and the outputs generated for you. We do not claim ownership of your inputs or outputs. We process them solely to deliver the Service.
Outputs are produced by third-party AI models. Their output may be inaccurate, incomplete, or unsuitable for your purposes. You are responsible for reviewing any output before relying on it for production, commercial, or safety-critical decisions.
Our Privacy Policy describes how we collect and use information. By using the Service, you consent to our data practices as described there.
You may close your account at any time. We may suspend or terminate your account if you materially breach these Terms or if continued service would expose us to legal risk. On termination, any unused balance is refunded to your original payment method.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws provisions. Any disputes shall be resolved in the state or federal courts located in Wyoming.
We may update these Terms occasionally. Material changes will be announced via the desktop app or email. Continued use of the Service after an update constitutes acceptance of the revised Terms.
